Terms of Service

The terms governing your use of the DarkThreatX platform and website.

These Terms of Service (“Terms”) govern your access to and use of the DarkThreatX platform, website and related services (the “Service”) provided by Attack Insights Software Pty Ltd (ABN 24 692 309 336) (“Attack Insights”, “we”, “us”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DarkThreatX provides dark web and breach monitoring, alerting and related intelligence. Features depend on your plan. We may update, add or remove features over time.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must promptly notify us of any unauthorised use.

3. Acceptable use

You agree not to misuse the Service, including by attempting to gain unauthorised access, interfering with its operation, reverse engineering it, using it to violate any law or the rights of others, or using monitoring data for any unlawful, harassing or harmful purpose. You may only monitor assets you own or are authorised to monitor.

4. Subscriptions, billing and free scans

Paid plans are billed in advance on the cycle shown at purchase and, unless stated otherwise, renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period. Fees are non-refundable except where required by law. Free scans and trials are provided as-is and may be limited or withdrawn at any time.

5. Intellectual property

The Service, including all software, content and trademarks, is owned by Attack Insights or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain rights to the data you submit.

6. Data and privacy

Our handling of personal information is described in our Privacy Policy. To request removal of your data from our systems, email [email protected].

7. Disclaimers

The Service is provided “as is” and “as available”. While we strive for accuracy and timeliness, dark web monitoring cannot detect every exposure, and we do not warrant that the Service will be uninterrupted, error-free or that it will identify all relevant threats. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

8. Limitation of liability

To the maximum extent permitted by law, Attack Insights will not be liable for any indirect, incidental, special or consequential damages, or loss of data, profits or goodwill, arising from your use of the Service. Where our liability cannot be excluded, it is limited to the amount you paid for the Service in the 12 months before the claim.

9. Indemnity

You agree to indemnify Attack Insights against claims arising from your misuse of the Service or breach of these Terms.

10. Termination

We may suspend or terminate your access if you breach these Terms or to protect the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

11. Governing law

These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of its courts.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date. Continued use of the Service constitutes acceptance of the updated Terms.
